Resolution assigning specific numbers for telecoms services approved in Brazil

Approved on 15 March 2022, Anatel Resolution No. 749/2022 determines the assignment of specific numbers for telecoms services. The new resolution aims to ensure that current regulations keep up with the sector’s rapid technological development, especially with regard to the internet of things (IoT) and machine-to-machine (M2M) solutions – ensuring compatibility, integrated operations and interconnection between networks.

Anatel launches public consultation on proposed telecommunications regulation on numbering resources

​The Brazilian National Telecommunications Agency – ANATEL released Public Consultation No. 37 to receive comments and suggestions from the public on the draft of the Telecommunications Numbering Regulation.

The proposal derives from the fact that current numbering resource regulations require updating, in light of recent developments in this sector, especially due to (i) the expressive increase in the use of mobile broadband services, provided under the Brazilian Personal Mobile Service (“PMS”) (Serviço Móvel Pessoal – SMP); (ii) increased demand for numbering resources in connection with the development of machine-to-machine communication (“M2M”) and Internet of Things (“IoT”) solutions; (iii) lack of standards regarding the granting of telephone numbering resources to be used in different types of telecommunications services.

ANATEL expects that the new regulation will contribute to update, simplify, and create a clear standard to address the new reality experienced in the telecommunications sector, which will centralize in a single regulation the granting of numbering resources.

The draft of the Telecommunications Numbering Regulation addresses the following topics, among others: 

(i) Definition of numbering resources to be utilized in the provision of Multimedia Communication Service (“MCS”) (Serviço de Comunicação Multimídia – SCM), which will enable the expansion of Voice over IP solutions (“VoIP”), especially receiving calls originated from the public network by VoIP terminals;

(ii) Waiver for M2M and IoT terminals from using numbering resources when voice or text messaging services are not provided, leaving the telecommunication service providers free to use the most adequate identification numbers available;

(iii) Standardization of numbering resources encompassing different telecommunications services and geographic areas, with the granting of a non-geographic character to prefixes of single national numbers;

(iv) Update of the technical criteria for identification of telephone numbers of public utility, which allows operators to share the same access codes among different entities providing the same public utility services;

(v) Creation of specific criteria for the attribution of carrier selection codes for fixed and mobile telecommunications service providers; and

(vi) Creation of a Numbering Plan for the Global System for Mobile Communications provided by Non-geostationary Satellites (“GSM”), based on that available for rendering of PMS.

Contributions may be submitted via ANATEL’s Public Consultation System until June 22, 2020.

Anatel makes public consultation on the 5G advertising for bids available

​On February 17, 2020, the National Telecommunications Agency – ANATEL initiated a public consultation process on the Advertising for Bids for radio frequency bands that will enable the implementation of the fifth generation (5G) technology in Brazil.

This is the largest frequency auction in ANATEL’s history, in which the 700 MHz, 2.3 GHz, 3.5 GHz and 26 GHz bands will be auctioned. The winning bidders are expected to make commitments to increase fixed broadband infrastructure and access to mobile services in areas of less commercial interest, under the terms of the Structural Plan for Telecommunications Networks – PERT.

The Advertising for Bids allows the participation of foreign companies and consortia. The term of validity of the licenses is twenty (20) years, extendable upon payment, pursuant to the regulations in force at the time of expiration.

In addition to the bidding process for 5G radio frequency bands, the public consultation also addresses the following issues:

  1. Amendments to the regulation of the 3.5 GHz band and approval of the regulation for the 26 GHz band;

  2. Amendments to the Personal Mobile Service Authorization General Plan – PGA-SMP;

  3. List of localities and municipalities eligible for commitments regarding the 700 MHz, 2.3 GHz and 3.5 GHz bands;

  4. Pricing study of the bidding process, including the commitments regarding the 700 MHz, 2.3 GHz, 3.5 GHz and 26 GHz bands.

Contributions must be made through ANATEL’s Online Public Consultation System and submitted by April 2, 2020.
