Real estate funds win multimillion dispute
A recent ruling by the 1st Panel of the Superior Chamber of Brazil’s Administrative Council of Tax Appeals (CARF) has effectively halted a key debate for the National Treasury over the taxation of real estate investment funds. The panel rejected the precedent rulings submitted by the federal government—required for the appeal to proceed—on the grounds that they apply only to cases involving fraud. With no other applicable precedent available—aside from the Península Fund case involving businessman Abilio Diniz—experts say the tax authorities now have limited scope to overturn unfavorable decisions at the body’s final instance.
