Business & Human Rights
We have been assisting companies in integrating respect for human rights into their business for over ten years, aligning their strategies with international guidelines (such as International Human Rights Treaties and the UN Guiding Principles on Business and Human Rights), as well as sparse internal regulations that promote fundamental rights.
Our multidisciplinary group – part of the social pillar of our ESG efforts – assesses potential human rights-related risks and develops solutions for prevention, mitigation, and potential reparation. These solutions contemplate companies’ interactions with stakeholders such as employees, competitors, consumers, suppliers and value chains, investors, and local and traditional communities.
We tailor customized models for different sectors, including the mining, food and beverage, technology, textiles, retail, and real estate sectors, as well as financial markets. Moreover, we assist with crisis management, helping companies to make prompt and assertive decisions in response to critical situations that could affect their reputation.
We have pioneered customized solutions that address corporate human rights violations, combining commercial pragmatism with respect for fundamental rights
Our main services
We develop and revise institutional policies and codes of conduct, addressing interactions with various stakeholders – including employees, consumers, local communities, human rights advocates, and members of value chains. We also provide advice on external communications and review corporate reports.
We map human rights violations applicable to several economic sectors, assess potential risks, identify areas of sector-specific exposure, and address material violations of different legal areas, such as socio-environmental and labor (among others) to guide clients in taking preventive or mitigating measures.
We structure reparation plans and measures for human rights violations, considering governance aspects and their efficient execution based on each pillar of reparation (restitution when possible, financial compensation, rehabilitation, satisfaction and memorialization, and guarantee of non-repetition).
We implement measures that influence respect for human rights in companies’ relationships with their stakeholders – such as suppliers, industry players, and partners they have contractual ties with. This includes contractual provisions and business conditions that promote human rights and encourage counterparts to act appropriately. Additionally, it involves implementing and monitoring grievance mechanisms.
We facilitate training sessions and capacity building on the specificities of the Business and Human Rights agenda for a range of different audiences. This includes top management (C-Level), middle management, and other employees exposed to human rights violations in their roles. It also extends to third parties that the company has business relationships with (e.g., suppliers).
We negotiate with public authorities to create extrajudicial agreements that safeguard the human rights of those involved. Additionally, we represent parties in legal actions to address human rights violations resulting from business activities.
We structure investments, projects, ventures, and other business models aligned with Brazilian and international human rights guidelines.
We provide legal assistance with conducting Free, Prior, and Informed Consent (FPIC) consultations with traditional communities impacted by business activities. We also support the implementation of impartial and effective grievance mechanisms.
