New Resolution consolidates the natural gas regulatory framework

On March 18, 2016, the Brazilian National Agency of Petroleum, Natural Gas and Biofuels (“ANP”) enacted Resolution No. 11/2016 (“Resolution”), which revokes ANP’s Resolutions Nos. 27/2005 and 28/2005.

The Resolution regulates important matters governed by the gas law and Federal Decree No. 7,382/2010 which had not been addressed so far. The Resolution covers:

- Open access to natural gas transportation pipelines;

- Request by shippers to swap natural gas;

- Assignment of rights and obligations under a transportation service agreement for firm transportation of natural gas;

- Procedure for registration of gas transportation agreements with ANP;

- Rules for provision of natural gas transportation services by transporters; and

- New public call procedure for contracting natural gas transportation capacity with transporters.

The Resolution was highly anticipated by the natural gas industry. It consolidates the regulatory framework for natural gas focusing on natural gas transportation and encouraging the development and competition of the gas market in Brazil.
